Terms of Use

These Terms of Use ("Terms") govern your access to and use of the Empiric AI website at empiric.io (the "Site"), operated by Empiric Strategies Pte Ltd, trading as Empiric AI ("Empiric", "we", "us"). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, do not use the Site.

1. About Empiric and the Site

Empiric AI is a specialist firm putting AI into production for Fortune 500 organizations and regulated institutions. The Site is informational. It is not an offer, a binding proposal, or professional advice. Engagements are governed by separate written agreements.

2. Permitted use

You may access and view the Site for lawful, personal, and internal business purposes. You agree not to:

• Reproduce, distribute, or create derivative works from the Site or its content for commercial purposes without our prior written consent.
• Use the Site to upload, transmit, or distribute any unlawful, harmful, infringing, or malicious content.
• Probe, scan, or test the vulnerability of the Site, or breach any security or authentication measures.
• Interfere with or disrupt the operation of the Site, including by means of automated access that imposes an unreasonable load.
• Use the Site or its content to train any machine learning model in a manner that violates applicable law or our intellectual property rights.

Reasonable, good-faith indexing by search engines and AI assistant crawlers is welcome and expressly permitted, in accordance with our robots.txt and llms.txt.

3. Intellectual property

The Site, including its text, images, logos, layout, design, code, and the names "Empiric", "Empiric AI", and "RankBetter", are owned by Empiric or its licensors and are protected by intellectual property laws. Except as expressly permitted by these Terms, no rights are granted to you in any of the foregoing. References to client logos and brand names are for informational purposes; all such marks remain the property of their respective owners.

4. Booking, scheduling, and inquiries

If you book a meeting or contact us through the Site, you agree to provide accurate information and acknowledge that the relevant communication may be processed by third-party scheduling, video, or email tools. Use of those tools is also subject to their own terms.

5. Third-party links and services

The Site may link to third-party websites or services that we do not control. We are not responsible for their content, availability, or practices. Your use of those services is at your own risk and subject to their terms.

6. Disclaimers

The Site and its content are provided on an "as is" and "as available" basis. To the maximum extent permitted by law, Empiric disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, completeness, and non-infringement. Empiric does not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components.

7. Limitation of liability

To the maximum extent permitted by law, Empiric and its officers, employees, partners, agents, and licensors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or in connection with your use of the Site, even if advised of the possibility of such damages. The total aggregate liability of Empiric for any claim arising out of or relating to these Terms or the Site will not exceed one hundred US dollars (USD 100). Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.

8. Indemnification

You agree to defend, indemnify, and hold harmless Empiric and its affiliates from any claim, loss, or damage, including reasonable legal fees, arising out of your breach of these Terms or your unlawful use of the Site.

9. Changes to the Site and these Terms

We may modify the Site or these Terms at any time. The "last updated" date at the top of this page indicates the most recent version. Continued use of the Site after the effective date of any change constitutes acceptance of the updated Terms.

10. Termination

We may suspend or terminate your access to the Site at any time, for any reason, including suspected violation of these Terms. Sections that by their nature should survive termination, including intellectual property, disclaimers, limitation of liability, and indemnification, will survive.

11. Governing law and jurisdiction

These Terms are governed by the laws of Singapore, without regard to its conflict of laws rules. The courts of Singapore have exclusive jurisdiction over any dispute arising out of or in connection with these Terms or the Site.
